1. Acceptance of Terms
By accessing or using the Horton Technical website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our website or engage our services.
These Terms constitute a legally binding agreement between you and Horton Technical ("we," "our," or "us"), a service provider operating in Moore County, North Carolina.
2. Services
Horton Technical provides the following services:
- Home security system installation and configuration (Ring, Blink, TP-Link Tapo)
- Smart home automation setup and integration
- Business security system installation
- CCTV camera system installation (Reolink)
- Website design, development, and management
- Technical consulting
The scope, pricing, and timeline for each project will be discussed and agreed upon during the consultation and quoting process before any work begins.
3. Quotes and Pricing
All quotes provided by Horton Technical are estimates based on the information available at the time of assessment. Final pricing may vary if the scope of work changes, unexpected conditions are discovered during installation, or additional equipment is requested.
Equipment is sold at manufacturer's suggested retail price (MSRP) with no markup. Installation labor is included in our package pricing unless otherwise stated. Any changes to the agreed scope will be communicated and approved by you before additional charges are incurred.
4. Scheduling and Appointments
Service appointments are scheduled based on mutual availability. We will make reasonable efforts to arrive within the agreed timeframe. If we need to reschedule, we will notify you as soon as possible.
If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice. Repeated no-shows or last-minute cancellations may result in a cancellation fee.
5. Payment Terms
Payment is due upon completion of services unless other arrangements have been agreed to in writing. We accept cash, check, credit and debit cards, Zelle, and Venmo.
For larger projects, a deposit may be required to secure the appointment and order equipment. Deposit amounts and terms will be clearly communicated before work begins.
Past-due invoices may incur a late fee of 1.5% per month on the outstanding balance after 30 days.
6. Warranty and Workmanship
All installations performed by Horton Technical come with a 90-day workmanship warranty. This warranty covers defects in installation, wiring, mounting, and initial configuration. It does not cover:
- Equipment defects or failures (covered by the manufacturer's warranty)
- Damage caused by misuse, tampering, power surges, or acts of nature
- Issues caused by changes made to the system by someone other than Horton Technical
- Normal wear and tear, including battery replacement
To make a warranty claim, contact us within the 90-day period with a description of the issue. We will troubleshoot remotely when possible and schedule an on-site visit if necessary at no additional charge.
7. Equipment and Third-Party Products
Horton Technical installs and configures equipment manufactured by third parties, including Ring, Blink, TP-Link, and Reolink. We are not the manufacturer of these products and do not control their firmware, software updates, or cloud services.
Equipment warranties, subscription services (e.g., Ring Protect), and cloud storage plans are provided directly by the manufacturers and are subject to their terms and conditions. We will assist with initial setup but are not responsible for ongoing third-party service changes or outages.
8. Website Services
For website design, development, and management services, the following additional terms apply:
- You retain ownership of all original content (text, images, logos) that you provide to us
- We retain ownership of custom code, templates, and design elements we create until final payment is received, at which point ownership transfers to you
- Ongoing hosting and management services are billed on a recurring basis and may be cancelled with 30 days' written notice
- We are not responsible for content you publish on your website after handoff
9. Limitation of Liability
To the fullest extent permitted by North Carolina law, Horton Technical shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to:
- Losses resulting from security system failure, including theft or property damage
- Interruptions to smart home automation or camera systems
- Loss of data, revenue, or business opportunities
- Damages arising from third-party product failures or service outages
Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim. Security systems are a deterrent and monitoring aid; they do not guarantee the prevention of break-ins, theft, or other criminal activity.
10. Customer Responsibilities
By engaging our services, you agree to:
- Provide accurate information about your property and requirements
- Ensure safe and reasonable access to the work area during scheduled appointments
- Maintain your equipment according to manufacturer recommendations
- Keep software and firmware up to date as recommended
- Secure your Wi-Fi network and account credentials
- Inform us of any relevant property conditions (e.g., HOA restrictions, rental agreements) before installation
11. Website Use
When using the Horton Technical website, you agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to any part of the website or its systems
- Submit false or misleading information through forms
- Scrape, copy, or reproduce website content without written permission
We reserve the right to restrict access to the website at our discretion.
12. Intellectual Property
All content on the Horton Technical website, including text, graphics, logos, and design elements, is the property of Horton Technical or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.
13. Dispute Resolution
Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in Moore County, North Carolina, in accordance with the rules of the American Arbitration Association.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions.
14. Modifications to Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
